Thank you Supervisor Ballowe.  I find that interesting as it confirms that there was no basis for the hearing scheduled for December 14, 2016.

Mr. Jackson,

I can most certainly print a hard copy and forward to the supervisor per your request.  This is a courtesy as a taxpayer and resident.  Have a great weekend.

Greetings Town Clerk Mulé -

I just remembered that at recent Town Board meetings, the statement "I didn't receive the email" has been made by board members, implying that the Town's email system is occasionally faulty.  With that said, I request that your office produce a hardcopy of this email and provide it to the Supervisor's office in case the Town's email system does prove faulty delivering this message.

Please let me know if this is a reasonable and possible request.  Keeping the $0.25 per sheet fee for FOIL requests in mind, I am happy to pay any fees involved in processing this request, if there is need.

Thank you!

Jay Jackson

Greetings Supervisor Ballowe - Can you please provide the requested information?  The Code Enforcement Office has no information (according to the below response) and the Town Clerk suggests that you are the next avenue for fulfilling the information request.  Thank you!

Mr. Jackson,

I have attached a scanned document that partially shows your request with a note I attached to our Code Enforcement officer.  He has placed a posted note on that request stating “I don’t have anything on this”.

The Town of Boston Appeals Officer is Martin A. Ballowe, Boston Supervisor, 8500 Boston State Rd., Boston, NY 14025

Greetings Town Clerk Mulé - Thank you for your continued efforts!

I was just made aware of a Dec 14 2016 10am public hearing regarding 7306 Omphalius Rd via a public notice published in the Buffalo News.  In order to make an informed visit and/or statement during the hearing, I would like any and all information regarding the:

- Official Town of Boston newspaper

- property owner

- complaint that initiated the investigation

- results of the investigation (ie. the notice served to the property owner per Town Code 47-3 & 47-4)

- date the property owner was served the notice

- notice of pendency (if any) that was filed with the Erie County Clerk

- communication from the property owner to the Town of Boston in response to the notice regarding repairs or removal of the structure

Note that the public notice for the hearing was published Nov 25 for a hearing date of Dec 14, however your office may require up to 21 days to answer a FOIL request such as this, thus preventing a citizen from being well informed in time for the public hearing.  I do realize this request may not be answered in time for the public hearing.  Similarly note the 10am time of the hearing prevents most employed citizens from attending and voicing their opinions.

Thank you again for your time and efforts!

Jay Jackson
